Chapter 9 - The Deposition of Daniel Sterling

The conference room on the twenty-fourth floor of the Huntington Center in downtown Columbus smelled of expensive leather, lemon polish, and impending disaster. Through the floor-to-ceiling glass windows, the Scioto River cut through the city like a ribbon of gray slate beneath an overcast sky.

Judge Harrison had ordered an immediate, mandatory four-hour settlement deposition before hearing Harold Ross’s emergency petition the following morning. The goal was to force the parties to resolve the explosive custody claims behind closed doors to avoid a public circus.

Harold Ross had clearly not gotten the memo that he was walking into an ambush.

Ross sat at the far end of the mahogany conference table, a squat, pugnacious man in his sixties with a comb-over and cufflinks the size of silver dollars. To his left sat Daniel, looking exhausted, wearing a charcoal Armani suit that seemed slightly too large for his sunken frame.

Sitting in the corner of the room, looking visibly pale and clutching her pregnant belly through an emerald maternity dress, was Chloe.

She wasn't supposed to be here. Harold Ross had violently objected to her presence, but Marcus Vance had invoked her status as a named interested party in Daniel’s financial disclosures. Chloe looked shattered. The bright, smug smile she had worn at the Dublin country club was entirely gone, replaced by red-rimmed eyes and a tight, terrified silence. She hadn't looked at Daniel once since entering the room.

“Let the record show,” the court reporter droned, her fingers poised over her stenotype machine, “this is the deposition of Daniel Sterling, taken in the matter of Sterling v. Sterling, Franklin County Court of Common Pleas.”

Harold Ross leaned forward, resting his thick forearms on the table. “Let’s dispense with the pleasantries, Marcus. This is an open-and-shut case of gross maternal concealment. Sarah Sterling deliberately hid the existence of two male children from their biological father to extract emotional revenge. Mr. Sterling is prepared to offer full legal indemnification, three thousand dollars a month in retroactive child support, and a structured physical custody schedule starting with alternating weekends.”

Ross tossed a legal draft across the table toward Marcus Vance.

“Sign this today,” Ross growled, “and we withdraw our fraud petition. Refuse, and tomorrow morning, Judge Harrison will hear testimony regarding Sarah’s financial instability, her questionable business practices, and her deliberate efforts to alienate these boys from their rightful family.”

Marcus Vance didn’t even look at the paper. He didn't pick it up. He simply leaned forward, clasped his hands loosely on the polished mahogany, and smiled.

“Mr. Ross,” Marcus said mildly, “your client is under oath. I suggest you advise him very carefully before he opens his mouth.”

Marcus turned his gaze to Daniel.

“Mr. Sterling, on November 10, 2020, you finalized your dissolution of marriage from my client, Sarah. Correct?”

“Yes,” Daniel muttered, shifting uncomfortably in his leather chair.

“And during that dissolution, you repeatedly asserted in court filings that Sarah was biologically incapable of bearing children, citing ‘irreconcilable differences arising from intractable medical infertility.’ Did you not?”

“That’s what she told me!” Daniel said defensively, his voice rising. “For seven years, we went to clinics! We did three rounds of IVF! Nothing worked! How was I supposed to believe she magically got pregnant right as we signed the separation agreement? It made no medical sense!”

“And yet, two days after your dissolution was finalized, a certified courier from Ohio Reproductive Medicine arrived at your office on High Street. You claimed in your affidavit filed yesterday that your receptionist turned that courier away without your knowledge. Is that your sworn testimony, Daniel?”

Daniel’s eyes flicked nervously toward Harold Ross. Ross gave a microscopic nod.

“Yes,” Daniel lied smoothly. “I was out of the office in meetings all day. My assistant handled incoming deliveries. She stamped it refused because she thought it was unsolicited medical billing. I never saw it.”

Marcus Vance nodded slowly, as if Daniel had just answered the easiest question on an elementary school quiz.

“I see,” Marcus said. He reached into his leather folder and pulled out a stack of pristine, color-printed documents, sliding the top copy across to the court reporter, one to Harold Ross, and one directly into Daniel’s trembling hands.

“Marking this as Exhibit D,” Marcus announced. “This is the digital forensic log from the United States Postal Service, subpoenaed this morning under expedited order from the district supervisor.”

Daniel looked down at the paper. The color instantly drained from his face until his skin matched the white linen of his pocket square.

“Do you recognize that signature, Daniel?” Marcus asked, his voice ringing through the silent conference room like a death knell. “The digital stylus capture from November 12, 2020, at eleven-fourteen in the morning? That is your signature, isn't it?”

Daniel’s mouth opened, but no sound came out.

“Read the memo line, Daniel,” Marcus commanded, his voice hardening into absolute authority. “Read it out loud for the court reporter.”

“Objection!” Harold Ross barked, his face turning an alarming shade of crimson as he lunged forward to grab the document. “This is ambush discovery! This document was not produced in preliminary disclosure!”

“It was produced two hours after you filed a fraudulent affidavit, Harold!” Marcus shot back, slamming his hand down on the table with a force that rattled the water glasses. “Read the line, Daniel! Or I will have the federal postal inspector standing in the hallway arrest you for perjury before you make it to the elevators!”

“Daniel?” Chloe’s voice broke the air.

It was a small, cracked whisper from the corner of the room. Chloe had stood up, her hand pressed against the arm of her chair, her eyes wide with mounting horror as she looked at her husband.

“Daniel… did you sign that?” she asked, tears spilling freely down her cheeks. “You told me she tricked you. You told me she kept them a secret to destroy us today. Did you know? Did you know four years ago?!”

“Chloe, sit down!” Daniel snapped, his panic boiling over into blind rage. “This is a legal proceeding! Shut up and sit down!”

“Don’t you dare tell me to shut up!” Chloe screamed, taking two heavy, trembling steps toward the table. “My father gave you three million dollars! I married you because you told me you wanted a family—because you said your ex-wife was a cold, barren woman who ruined your youth! And you had two sons?! You left your own babies in an envelope so you could take my father’s check?!”

“Chloe, please!” Daniel begged, half-rising from his chair, reaching toward her. “It was about the trust! If Richard found out I had children from my previous marriage, the prenuptial agreement wouldn't have given me access to the logistics expansion funds! I did it for us! I did it for the company!”

The silence that followed was suffocating.

Daniel froze, his hands still extended toward Chloe, the realization of what he had just admitted under oath crashing down on him like a falling ceiling.

He slowly turned his head to look at the court reporter. Her fingers were still moving rhythmically across the keys, recording every single syllable.

Harold Ross slumped back in his chair, closed his eyes, and pinched the bridge of his nose. He knew it was over. He was a ruthless lawyer, but he wasn't an idiot. His client had just committed perjury, confessed to financial fraud against his father-in-law, and admitted on the record that his custody petition was motivated entirely by a corporate inheritance scheme.

Marcus Vance leaned back in his leather chair, laced his fingers together, and looked at Daniel with cold, devastating finality.

“Thank you, Mr. Sterling,” Marcus said quietly. “We have no further questions for this deposition. We will see you in front of Judge Harrison tomorrow morning.”
